Consequences and Needs

Outline

This section on “Consequences and Needs” deals with the consequences of CRSV for the victims/survivors of CRSV as well as for others (e.g. family, friends, communities, society at large). It also deals with the needs of victims/survivors of CRSV: in other words, what do they need to address the consequences of the CRSV inflected upon them. What are best practices in this regard? This section is divided into: (1) physical consequences and needs; (2) psychological consequences and needs; (3) socio-economic consequences and needs; and (4) legal consequences and needs. Each subsection ends with a best practice example.

Relief for victims/survivors in periods of acute crisis and emergencies (in particular via humanitarian aid), and assistance in long-term reconstruction and recovery (in particular via national and local NGOs), should be based on the victims/survivors’ actual needs. Providing the basic needs of victims/survivors and of the family members they are responsible for, is a first step towards their participation and leadership in humanitarian aid, peace processes, reconstruction and recovery. International obligations related to (gender-sensitive, gender-responsive and gender-transformative) relief, reconstruction and recovery can be found in, for instance: UN Security Council Resolutions on Women, Peace and Security 1325 (2000), 2106 (2013), 2122 (2013), 2467 (2019), and 2493 (2019); CEDAW Committee General Recommendations 28 (2010), 30 (2013), and 32 (2014); Global Compact on Refugees (2018); Social Development Goals (SDGs) 5.1, 5.2, 5.5, 5.6, 5.c, 10.3, 10.4, 10.7, 11.1, 11.7, and 16.b; different forms of reparations exist as outlined in the UN Basic Principles and Guidelines on the Right to a Remedy, and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law (2005) (i.e. restitution, compensation, satisfaction, rehabilitation, guarantees of non-repetition); and the Nairobi Declaration on the Right of Women and Girls to a Remedy and Reparation (2007).
